- Scope of the platform
1.1.- NASH is an e-shop apparel retailer, which enables users to purchase the products displayed, by submitting an online order, subject to the availability of products in stock.
1.2.- The electronic platform and its relevant services are provided by the company under the trading name «NASH Ε.Ε.» based in Metamorfosi Attica.
1.4.- NASH may, on occasions, amend these terms and conditions as well as the related services provided.
- Subject and Services
2.1.- On the website various types of women’s clothing are displayed, which are created by the fashion designer Natasa Avloniti and are available for sale.
2.2.- In particular, when browsing the NASH website, you may track down the products that are currently available for sale at the online store.
2.3.- If you wish, you can subscribe to our newsletter, in order to be kept updated for exclusive offers, new collection arrivals, discount coupons etc.
2.4.- NASH may at any time include any other additional services.
- General obligations and rights
3.1.- NASH reserves the right, at its sole discretion, to freely choose the products displayed on its site and to modify, renew or even withdraw them at any time, without prior notification. The same holds for its pricing policy, but also for the aforementioned – additional services (offers, discount coupons etc.), which may also be selected, modified, renewed, withdrawn at any time and without prior notice.
3.2.- Website’s whole content, including images, graphics, photographs, designs and texts, constitute intellectual property of NASH, and none of these may be sold, copied, modified, reproduced, republicated or redistributed, without the specific prior written permission of NASH.
4.1.- All products displayed on the online platform are unique and are tailored upon request. Therefore, although NASH make its best effort for fast delivery of the products, has no liability for possible delay.
4.2.- In the frame of transactions (and subject to clause 7 – terms of cancellation), NASH shall not be liable for any further damage or loss, arising from cancellation, nonperformance, or delay of orders, or from any other reason.
4.3.- NASH is under no circumstances liable for any malware, viruses or other harmful elements from third parties, whether regarding company’ s site or any other websites to which the user may be directed through links, hyperlinks or any advertising.
- Pricing and Payment
5.1.- Use of the website, as well as any communication through it, including any requests relatively to visits to the designer’s showroom, is free of charge.
5.2.- When browsing through our shop section, each product listed comes with a brief description of its features, its stock availability and its price. In order to complete the order, NASH requires from the user to enter all the personal data which are necessary for the payment (e-mail address, credit/debit card number, beneficiary name, address, postcode, country, etc.).
5.3.- Each payment is implemented either by cash on delivery (COD) – only in case the delivery is carried out within Greece – or by electronic means (e-payments), using a credit/debit card (e.g. PayPal, Apple Pay, etc.). In case of payment by cash on delivery, the user will be charged with the cost of cash on delivery which amounts to two euros (€2).
5.4.- For each electronic payment, user will be directed through hyperlink to a secure environment, where he shall complete the special-order form, in which he is required to enter his card number and its expiration date, as well as the 3-digit number (CVV) on the back of the card.
5.5.- For each domestic purchase, the user will be charged shipping costs, which amount to five Euros (€5), while in the case of shipping a product to Cyprus, shipping costs amount to fifteen Euros (€15). For shipments that will take place inside and outside the European Zone, the cost will be calculated on a case-by-case basis and will be notified to the interested user before the purchase is completed. Especially in the case of purchasing and shipping a product outside the European Zone, duties and taxes are calculated based on the destination of the products as well as the number of products and the total value of the order. Cash on delivery will exist, as a method of product payment, only in the case of a domestic purchase (cf. Clause 5.3).
5.6.- Please note, that these amounts can fluctuate according to the pricing policy of any collaborating transport company.
5.7.- SALES PERIOD. In terms of promotion or for marketing purposes, preferential prices may apply on certain products in a given time period. To take advantage of these offers, user has to complete his/her order exclusively during this timeframe as referred to the platform.
- Shipping and delivery
6.1.- After completing the order, NASH takes every necessary action for its timely and safe delivery to the customer. After the purchase, user receives a confirmation email containing all the order details. In the event that a problem occurs at any stage of the order, the NASH customer service department will contact the user as soon as possible.
6.2.- All products are shipped within three (2) to twelve (15) working days of the order date.
6.3.- The hereinabove time limits are indicative. In case of orders’ increase, shipments may exceed the estimated delivery time. Hence, each user will be able to be informed for the progress of his shipping via email at email@example.com, or by tel. (+30 2018080727), after submitting a full order reference.
6.4.- All products shipped are subject to scrupulous and quality control. If, however, a product turns out to be defective, you may refuse shipping and request its immediate replacement following a telephone or other consultation. You are therefore required to check the product upon the delivery time of your order, as well as the intact of the packaging, in order to identify any obvious defects.
- Cancellation policy and returns.
7.1. Cancellation policy.
7.1.1- Cancellation of an order means any cancellation action that takes place within twenty-four (24 h) of placing it and in any case before the products are received by the user. After placing the order, its cancellation will be accepted within twenty-four (24 h) hours.
7.1.2.- If there is a timely cancellation as defined above, the amount will be returned to the beneficiary within two (2) working days, subject to the bank’s policy.
7.2.- Return Policy.
After the 24-hour deadline has expired (as defined in Clause 7.1.), the user has the option, within fourteen (14) days from the day of receipt of the products, of the following options:
- A) Refund.
- B) Product change.
- C) Issuance of a credit amount.
7.2.1- Returning products to NASH is done exclusively with the cooperating transport company that carried out the shipment and within the above defined period of fourteen (14) days from the day of their receipt by the user. Products must be returned strictly in their original condition, without damage or defects, in their original packaging with
- the company’s accompanying card,
- the changes/return FORM (cf. Clause 7.6.) completed,
- the corresponding proof of purchase, the presentation of which is necessary.
The costs of returning the product are borne exclusively by the user, who additionally bears any customs charges. The acceptance or non-acceptance of the return will be decided after a quality check by our company and the condition of the returned product has been assessed.
7.2.2- The refund will be made depending on the way the product was originally paid for and the banking institution’s policy and may take from five (5) to fifteen (15) business days. In case of payment of the product, during the initial purchase, with the cash-on-delivery procedure, the refund of the entitled amount will take place by crediting the bank account indicated by the user as he will notify the company by filling in the relevant form in the Clause 7.6. as detailed below.
7.2.3.- In the event that the products have already been received by the user and in order to complete the refund process to him, the return of the products to the company must be carried out within fourteen (14) days from the day of receipt.
7.3.- Product Changes are possible within fourteen (14) days from the day they are received. The product change can be made only once. If the unsuitability of the product is not due to the negligence of the company, the user will bear the additional shipping costs incurred. Products awarded as gifts are not subject to change.
7.4- Cancellations and refunds are not accepted in the following cases: a. for purchases that have been made in discount products, flash sales, with discount coupons, b. to products granted as contest gifts (giveaways), c. on products purchased within the showroom, d. on purchases derived from credit amounts, e. on products derived from change.
7.5.- For purchases of more than one (1) product, a refund request or change is only possible for one (1).
7.6. – Discount vouchers cannot be used to purchase products already on sale.
7.7.- For product returns, you shall complete the following FORM. Any further relevant request by the concerned user will be forwarded solely by email to firstname.lastname@example.org, and always with a full order reference.
- Personal Data Protection
8.1.- NASH may retain users’ personal data in order to ensure the timely and appropriate shipment of products, as well as for further marketing purposes, tax obligations etc.
- Applicable law and jurisdiction
9.1.- These terms and conditions shall be governed by and will be interpreted in accordance with the laws of Greece, where NASH has it’ s registered office.
9.2.- All disputes arising out of or relating to the herein agreement, shall be submitted to the exclusive jurisdiction (both subject-matter and territorial) of the Greek courts.
- Final provisions
10.1.- Partial invalidity: In case any term is -for any cause- found to be invalid or cancelled, the remaining terms and conditions shall remain in force and unaffected.
10.2.- User declares that he/she has read and understood all the terms and conditions above and accepts them without prejudice.
